Terms of Sale

These terms apply to anything you buy from us. What you are buying, and what it costs, is described at the point of purchase before you confirm.

We are PRIVACY PICKET PTY LTD (ACN 655 636 981, ABN 11 655 636 981), a company registered in Victoria, Australia.

Two kinds of thing we sell

The terms differ, so it matters which one you are buying. It will always be clear at the point of purchase.

  • Digital products. Reports, downloads, and similar, bought online and delivered immediately. Covered in full by this page.
  • Professional services. Consulting, assessment, and advisory work. Scope, fees, and terms are agreed with you in writing before the work starts, and that written engagement governs. This page does not override it.

Who you are buying from

Digital products may be sold and processed by a payment provider acting as merchant of record. Where that applies, they are the seller of record on the transaction, their name appears on your receipt and statement, and they handle payment processing and any sales tax, VAT, or GST due where you are. We produce and deliver the product.

Price and delivery

The price is the one shown at the point of purchase, in the currency shown, before you confirm. Digital products are delivered immediately unless stated otherwise.

Where a purchase is one-off it is not a subscription: nothing recurs and there is nothing to cancel. Where something is recurring, that will be stated plainly before you buy, along with how to cancel it.

Refunds

Digital products: 30 days, no questions asked. Email us within 30 days and we will refund you in full. You do not need to give a reason and we will not try to talk you out of it. See our Refund Policy.

Professional services: refunds and cancellation are as set out in your written engagement, because work already performed cannot be returned. Your rights under the Australian Consumer Law apply regardless, and are set out below.

What we sell is not a guarantee of security

Our reports and advice are built on information you give us and on generally accepted practice at the time. Following them will improve your position. They will not make you immune to a security incident, a breach, ransomware, or a claim.

Unless we say so explicitly in writing, nothing we sell is a certification, an attestation, or an assessment of compliance with any framework, standard, or regulation, and it is not legal, insurance, or financial advice.

Limitation of liability

To the maximum extent permitted by law, and subject to your consumer rights below, we are not liable for indirect, incidental, special, or consequential loss, including lost profits, lost data, business interruption, reputational harm, or the cost of responding to a security incident.

For digital products, our total liability is limited to the amount you paid for the product. For professional services, the limit is the one set out in your written engagement.

Your consumer rights

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law, or under any other law that cannot lawfully be excluded. Any term that tried to do so has no effect to that extent. This overrides the limitation above.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

If you are a consumer in the EU or the UK, your statutory rights are unaffected. Because digital products are delivered immediately, you are asked at checkout to agree that delivery begins straight away and to acknowledge that you lose the 14 day withdrawal right once delivered. Our 30 day refund is more generous and applies either way.

If part of these terms does not hold up

If any term here is found to be unenforceable, or unfair under the Australian Consumer Law, that term is severed and the rest continue to apply. Tell us and we will fix the wording.

Governing law

These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country you live in.

Changes

We may update these terms. The version that applies to your purchase is the one published at the time you bought.
